Venue Rental Agreement

Scope of Agreement

This Rental Agreement is between Valley Relics, herein referred as "Venue" and NAME hereinafter referred to as "Client." The purpose of the Agreement is to define the obligations of both parties pertaining to the rental of Valley Relics.

The Venue described in the Venue Rental Agreement has been reserved for Client for the date and time stipulated below:

Note: Your date will be reserved only after the deposit has been paid.

DATE, with a start time of (TBD) and an end time of (TBD) The hours assigned to your event include set up and cleanup of all subcontractors & vendors that you may use. It is understood you will adhere and follow the terms of this Agreement, and you will be responsible for any damage to the premises and site, including the behavior of your guests, invitees, agents, subcontractors, and vendors resulting from your use of Venue.

Booked Start Time & Event Timeline

Earliest time to arrive to set up for your event is (TBD) Set up time, event time, tear down and clean up time need to be within the hours you book. (TBD)– Tear down cleanup is complete. You, guests, subcontractors, vendors, etc. have left the Venue, left the parking lot and all items belonging to you, guests, subcontractors, vendors, etc. have been removed from the Venue.

Going over your booked end time

If you go over your booked end time this means anyone, whether it be you, guests, vendors, caterer, subcontractor, etc. are still inside the Venue, cleaning, talking, etc., will be billed additionally in increments of 30 minutes at a rate of $225.00 per 30 minutes. Even if a Venue staff member is still at the Venue shutting down and locking up, you may not occupy the Venue in any way, otherwise you will be charged. There is a 10-minute grace period where there is no additional charge. After 10 minutes you will be billed a minimum of $225 per 30 minutes.

Booking Date, Deposit & Cancellation Period

The rental fee and terms for Venue are described on the Venue Rental Agreement totaling AMOUNT for the Client’s event taking place on DATE from (TBD). A 50% deposit of AMOUNT is required to secure the above-mentioned date and is non-refundable after 10 days of paying the deposit. The balance of the rental fee is due 1 week before the event date. A credit card must be on file 1 week before the event that will be used to charge for going over booked end time.

Insurance

Proof of liability insurance is required and due one (1) week prior to your event. You can e-mail a copy the certificate of insurance to info@valleyrelicsmuseum.org

The Client must provide Valley Relics with a Certificate of Insurance carrying minimum policy limits as indicated:

l. Commercial Liability Insurance with a minimum of $1,000,000 per occurrence and $1,000,000 aggregate.

Client assumes full responsibility and liability for any and all damages to the Venue and items on display throughout the Valley Relics Museum.

Indemnity

The Client must provide Valley Relics with a certificate of insurance to read as follows:

Valley Relics, its board of directors, officers, executives, staff, volunteers, agents, and assigns are named as an Additional Insured as respects liability resulting from the negligence of the named insured, the named insured's guests, invitees, agents, and sub-contractors during event taking place on DATE.

Event Set-Up Limitations

All property belonging to Client, Client's invitees, guests, agents and sub-contractors, and all equipment shall be delivered, set up and removed during the rental period on the day of the event. Venue is not responsible for loss, damage, or theft of personal property belonging to the Client, Client's invitees, guests, agents, subcontractors, and vendors.

The Venue is a non-smoking facility. Please do not smoke inside the Venue or within 20 feet of the entrance, exit and roll up doors, per California Government Code Sections 7596-7598.

No rice, birdseed, confetti, real shells, marine life are allowed on the premises. Venue management must approve all decorations.

Caterers

Venue requires all caterers to hold an insurance policy with minimum policy limits of
$1,000,000 General Aggregate/$1,000,000 Per Occurrence with a $1,000,000 Host Liquor liability endorsement and carry current Los Angeles County health permits. Caterers must provide Valley Relics with a certificate of insurance to read as follows:

Host Liquor Liability limits must be itemized on the certificate of insurance in the "Other" box.

A copy of the caterers' current health permit must accompany the certificate of insurance.

Also, each subcontractors and vendors certificate of insurance must be included as a separate endorsement

(CG20 l 0 1185 or equivalent) naming Valley Relics, its board of directors, officers, executives, staff, volunteers, agents, and assigns as an additional insured.

These subcontractors include but are not limited to, caterers, valets, performers, photographers, entertainment, equipment rentals {tables/chairs/tents, etc.), portable toilets, florists, decorators, sound and lighting technicians, etc.

Caterers are required to use proper grease mats and any protection of the venue grounds necessary.

Alcohol Control

The managing and distribution of alcohol at your event is required to be performed by a licensed bartending company. Although the bartending service will manage the distribution of alcohol,

The Client is ultimately responsible for the safety of all its invitees, guests, agent, or subcontractors, including the distribution and consumption of alcohol.

Client's guests that appear to be thirty (30) years of age or under shall be carded by the bartending service, therefore, they must have either a valid driver's license or valid picture ID.

No alcohol may leave the premises of the Venue. Alcohol consumption is strictly forbidden outside the Venue.

Security

The Venue, at their sole discretion, may mandate that additional security personnel be assigned to your event, which may involve additional fees over and above your facility rental fee.

Parking

Limited parking is available within the Venue grounds as well as street parking. Parking within the Venue grounds and beyond is done so at your own risk. In no event shall Valley Relics, its board of directors, officers, executive's, staff, volunteers, agents and assigns be held liable to any of the Client's invitees, guests, agents or sub-contractors in the event of a loss not limited to theft, collision, or property damage, parking in restricted zones, and towing fees on the premises or surrounding areas.

Restricted Areas

Please be aware that the Venue is located on Federal Airport Property. No one at any time is allowed to enter, exit or access the back hangar doors on the west side of the Venue that are directly on the airport’s tarmac.

Clean Up

Client shall be responsible for returning the venue to the state that it was provided to them. All property belonging to Client, Client's invitees, guests, agents, subcontractors, vendors, etc., shall be removed by the end of the rental period stated on the Venue Rental Agreement. All property remaining on the premises beyond the end of the rental agreement will be discarded and any charges incurred to handle discarding such items will be billed to Client. Venue is not responsible for any property left behind by Client, Client's guests, invitees, agents, subcontractors, vendors, etc.

Venue Staff

A Venue staff member will be accessible throughout your event and will maintain the bathrooms with necessary supplies, as well as the three 45-gallon trash cans provided. The Venue staff member will ensure that the Venue and surrounding site are ready for your event and will check in with you prior to the beginning of your event. As the Client, you will be the designated contact for the Venue staff member to notify of any issues or concerns that need to be addressed regarding the Venue Rental Agreement before, during and after your event. A Venue staff member will check in with you at the end of your event.

Cancellation Policy

The event can be canceled 10 days after receipt of 50% deposit to receive full refund. After 10 days of paying the 50% deposit, the deposit is non-refundable. No exceptions.

Force Majeure

The ability to execute this Agreement by either party is subject to the Acts of God, including but not limited to hurricanes, flooding, earthquakes, fires, etc., as well as any government intervention, civil authority, terrorism, or other emergencies. Should the event be canceled through a Force Majeure event, all fees paid by Client to Valley Relics will be returned to Client within thirty (30) days.

Authorization

The person(s) signing the Agreement warrant that they are authorized to make agreements and to bind their principals to this Agreement.

Acceptance

Upon signing of this Agreement, a fully executed agreement will be in force.
